Terms travel et Inferno Race
The company Bcyclet, based in Geneva, offers cycling tours around Europe. These all-inclusive trips are available to people from all over the world in the form of a “guided tour”(with a guide) or a “self-guided” tour (without a guide).
The hereby Terms and Conditions apply to all contracts between Bcyclet Sarl, Place des Eaux-Vives 6, 1207 Geneva, Switzerland and the user (“you”) of the Bcyclet services.
1. Subject of the hereby contract
Bcyclet is organising a cycling tour for you. Bcyclet commits to
– Organising your trip from beginning to end according to the description in the Bcyclet literature;
– Organising the agreed accommodation
– Providing you with all other services included in the tour you have chosen.
2. Booking and payment
Booking a Bcyclet tour on the Internet implies subscribing by the means of the online booking form you can find on our website, as well as accepting the hereby Terms and Conditions (by using your curser to click agreed at the bottom of the hereby Terms and Conditions).
When booking a Bcyclet tour by email, post, telephone or face to face with a member of the Bcyclet team, please make sure you receive and sign a booking form and the present Terms and Conditions before sending them back to Bcyclet by post. By signing these documents, you agree to the hereby Terms and Conditions.
The availability of our tours is stated on our website but please bear in mind that this information is provided for information only. Your trip will only be officially booked when you receive a written confirmation from Bcyclet.
Tours:
Your booking will only be fully acquired when Bcyclet receives a deposit of 30% of the total price if you are paying more than 45 days before the tour begins. In this case, you will need to pay the remaining fee within 45 days before your tour. If you are paying less than 45 days before your tour begins, your booking will be fully acquired upon reception of a 100% payment. Bcyclet reserves the right to cancel your reservation if you fail to pay for the total of your tour 45 days before it begins. In this case, your 30% deposit will not be refunded.
Inferno Race:
Your booking will only be fully acquired when Bcyclet receives the full amount for your team of 2.
3. Cancelation on the customer’s behalf
In case of cancellation on your behalf, Bcyclet will charge the following cancellation fees:
Tours:
– Over 60 days before departure: 30% of the total tour cost, BUT this can be put towards a Bcyclet holiday or for a future bike rental from one of the Bcyclet offices (Alps, Provence, Corsica) during the 24 months following the first day of the cancelled tour.
– Between 59 and 30 days before departure: 30% of the total cost
– Between 29 days and 21 days before departure: 50% of the total cost
– Between 20 days and 7 days before departure: 75% of the total cost
– Less than 7 days before departure: 100% of the total cost
Inferno Race:
– Over 180 days before departure: 30% of the total tour cost.
-Between 179 days and 90 days: 40% of the total tour cost.
-Between 89 days and 60 days: 50% of the total tour cost.
-Between 59 days and 30 days: 70% of the total tour cost.
-Between 29 days and 15 days: 90% of the total tour cost.
-Less than 15 days: 100% of the total tour cost.
**Covid-19 exceptional cancellation conditions Inferno Race (valid for 2021 edition)
In case of cancellation of the 2021 Inferno Race edition, you will be able to put your payment towards the 2022 edition or in any other Bcyclet service (tours, rental, store)**
Your cancellation will be registered ONLY on receiving your written cancellation notice at our office, either by post to Bcyclet Sarl, Place des Eaux-Vives 6, 1207 Geneva, Switzerland, or by email to contact@bcyclet.com.
If you do not come to the agreed meeting at the beginning of your tour, or if you are unable to present the required administrative or medical documents (passport,visa, medical certificate…), your participation in our tour will be automatically cancelled and you will not be able to claim a refund. Interruption of the tour for reasons beyond your control (illness, insufficient physical preparation…) will not entitle you to a refund.
4. Bcyclet ‘s right to postpone or cancel
If Bcyclet is obliged to cancel the tour because the minimum number of participants is not reached, because the security participants is not ensured or because of any other force majeure incident, Bcyclet will do their best to offer you a satisfying replacement. If you are not interested in our replacement offer, you will be entitled to a full refund.
5. Modification/Alteration of the tour
Tours:
You may modify your choice of tour up to 60 days before the departure date, at the cost of 200€ per person.
Within less than 60 days before the departure date, all modifications will be considered cancellation and the appropriate cancellation fees will apply in accordance with Article 3 of the hereby Terms and Conditions.
Inferno Race:
No modification will be possible after registration
6. Third party products and services
Organising your tour entails Bcyclet to work with third party providers, including for transport (train,ferry, etc.) and rentals (bikes, equipment, etc.). In these cases, Bcyclet only stands as an intermediate meaning that any contract signed bonds you and the third party partner only.
Inconsequence, the prices charged by our third party partners are charged to you and the conditions of each third party contract will apply. Bcyclet will not be held responsible for the application or consequences of third party terms and conditions.
Bcyclet informs you of charges and conditions applied by partners in the clearest possible way.
Any fees charged by third parties due to booking or service modification will be at your own cost.
7. Prices
The price of your tour is the price stated on www. Bcyclet.com or offered to you by our team by email. The included and excluded services are detailed in your holiday description. Extra charges and special offers will also be stated clearly in this description. Prices offered to you by email over ride the prices quoted in our brochures and on our website.
Tours:
Bcyclet can change their prices at their sole discretion at all times. However, once your tour has been confirmed and you have paid your 30% deposit, the price of your tour will stay as agreed and can no longer be changed at Bcyclet’s sole discretion.
Inferno Race:
Bcyclet can change their prices at their sole discretion at all times. However, once your tour has been confirmed and you have paid the total tour cost, the price of your tour will stay as agreed and can no longer be changed at Bcyclet’s sole discretion.
Any spending or extra services not included in your original agreement with Bcyclet will be at your own cost. You will be asked to pay for these extra services yourself. If a member of the Bcyclet team covers these extra costs, you will be asked to refund these charges within one week following your tour. If these costs entail administrative work on Bcyclet’s behalf, a 100€ fee may be charged.
8. Liability
Bcyclet will not be held liable for participants. You are particularly held responsible for the acquisition of any necessary paperwork in order for the tour to take place (ID, visas, authorisations, medical certificates…). When travelling, you are responsible for your own luggage throughout the tour.
By organising holidays, Bcyclet is lead to work with third party providers (hotels, hostels, transport…). In no case is Bcyclet to be confused with these third party companies and Bcyclet will only be held responsible for their own actions and omissions.
Our tours include cycling on and off roads as well as outside activities that can include taking certain risks. By taking part in our tours, you consider your cycling level to be good enough to do so and your health condition to be excellent. Each participant is liable for the risks they take and in no case will Bcyclet and its team be held responsible for other companies’ services, staff, accidents or any other incidents that may occur during our tours.
You must conform to our safety rules and follow the advice and instructions given by the Bcyclet team or those of third party companies.
In any case, our liability is limited in scopeto [twice] the total price of the holiday and covers only direct and indirect damage.
9. Changes in the program by Bcyclet
Bcyclet will do their best to avoid having to change a tour’s program. However, Bcyclet has the right to change a tour’s itinerary and/or program, especially if the participants security is in question or if a third party were to default.
You take note that any extra costs related to the consequences of accidents, unforeseen and / or force majeure incidents (eg natural disasters, transport problems, strikesor anything out of our power) are your sole responsibility. When deciding on the expenditure to be incurred, Bcyclet will consult participants. Bcyclet will take the ultimate decision necessary for the participants safety.
10. Self-guided Tours
Our“Self-Guided tours” are routes / tours sold without a guide and without any third party services. The price includes a map showing the area to be covered and the GPS coordinates in a .gpx. format. By booking a self-guided tour, you confirm that you have good knowledge of map reading. You shall be solely responsible for accidents or incidents during your trip. Moreover, Bcyclet cannot be held responsible for your misinterpretation or your misreading of the map. You take note of the fact elements in the self-guided tour are subject to change.
10.1 Inferno Race
- Each participant is responsible for their own insurance coverage
- Each participant waives and releases the organisers from any responsibility and agrees to assume full responsibility for any risks of or personal injury, including death that may be sustained and loss of or damage to equipment.
- Whilst Bcyclet will endeavour to make sure that the event runs smoothly and and safe as possibly, each participant, accepts that the organisers cannot anticipate or control the risks that are inherent in a cycling event.
11. Insurance
Bcyclet has liability insurance according to the rules of our profession. By booking a trip with us, you confirm you will have the following from day 1 of the tour:
– Liability insurance covering the damage you could inflict on others;
– Accident insurance covering medical care and other expenses in the event of an accident;
– Personal casualty insurance covering the damage that may be caused on your property, trip cancellation, search and rescue operations, repatriation in the case of an accident and loss of luggage.
– If your insurance policy does not cover cancellation and repatriation, Bcyclet offers these as options with your tour. Either way, subscription to such insurance is compulsory.
12.Protection of personal data
If you use the Bcyclet website to make a booking and/or subscribe to the Newsletter, Bcyclet needs to collect information about you in order to process your request. Bcyclet is required to collect personal data such as your name, email address, mailing address, telephone number, nationality and date of birth.
Most webbrowsers automatically accept cookies. However, you can set your browser to prevent or restrict cookies. In this case, there may be some services the Bcyclet website is unable to provide.
By booking on the Bcyclet website and/or subscribing to the Newsletter, you agree to Bcyclet collecting this data and that Bcyclet can use, transmit and/or store it in a database to the extent necessary to provide you with the expected service. The Federal Act on Data Protection governs the processing of your personal data by Bcyclet.
Bcyclet should not disclose your personal data to third parties in any way, unless it is essential the performance of the company (eg. Communication with third party providers in accordance with Article 6 of the hereby Terms and Conditions).
The Bcyclet website is secured by appropriate technical and organisational measures to protect personal data that is transmitted. In particular, when you book your stay via the Bcyclet website, your transactions are processed through secure payment means. You have the right at all times to be informed of the personal data we have regarding yourself. You have the right to request correction or deletion. You can unsubscribe from our Newsletter at any time (via the link provided in the Newsletter). 13. Photos / illustrations
Photos and illustrations on our website do not have a contractual nature. Moreover, by accepting these Terms and Conditions, you agree that Bcyclet can use your image for promotional purposes (website, adverts…). In principle, Bcyclet will seek your consent before publishing a photo in which you are seen close up.
14 Claims
If you have a complaint to make about any of our holidays, please contact your guide or our office based in Geneva.
15. Ombudsman
In case of dispute, you can contact the Ombudsman of the Swiss travel industry. This person will look for a fair answer to the problems between you and us. 16. Applicable law and juridiction
Only Swiss law is applicable in the relations arising from the contract between you and Bcyclet. Subject to mandatory rules, courts have exclusive jurisdiction over any dispute in Geneva.
